These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User," "Member," or "you") and Faster Stronger Wiser LLC ("Company," "we," "us," or "our"), a California limited liability company. These Terms govern your use of all features, content, products, and services available through the FSW platform, including the website, mobile-optimized web app, fitness games, live class schedule, workout programs, wellness tracking, client coaching intake, and the FSW Live Strong Academy.

We reserve the right to update these Terms at any time. Continued use of the Platform after any update constitutes acceptance of the revised Terms.

You must be at least 18 years of age to use this Platform without restriction. Users between the ages of 13 and 17 may use the Platform only with verified parental or guardian consent. By using the Platform, you represent and warrant that you meet these eligibility requirements.

IMPORTANT — READ CAREFULLY: The fitness games, workout programs, wellness checklists, body stat tracking, live classes, and all content available on this Platform are provided for general informational, educational, and entertainment purposes ONLY.

This Platform does not provide medical advice, diagnosis, or treatment. No content on this Platform should be construed as medical advice or a substitute for professional medical evaluation, diagnosis, or treatment. Always seek the advice of a qualified physician, licensed physical therapist, or other qualified healthcare professional before beginning any new exercise program, nutrition plan, or wellness regimen.

Faster Stronger Wiser LLC expressly disclaims all responsibility for any injury, illness, adverse health outcome, death, property damage, or other harm — whether direct, indirect, incidental, consequential, or otherwise — arising out of or related to your use of or reliance on any content, programs, workouts, games, class instructions, or coaching provided through the Platform.

You acknowledge that: (a) physical exercise carries inherent risk; (b) you are voluntarily participating with full knowledge of those risks; (c) you are solely responsible for determining whether any workout, exercise, or program is appropriate for your individual health condition, fitness level, and physical limitations; and (d) you assume all risks associated with your participation.

BY USING THIS PLATFORM, YOU EXPRESSLY ASSUME ALL RISKS ASSOCIATED WITH PHYSICAL EXERCISE, ONLINE FITNESS CLASSES, WORKOUT PROGRAMS, AND ANY ACTIVITIES SUGGESTED OR DESCRIBED ON THIS PLATFORM.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU HEREBY RELEASE, WAIVE, DISCHARGE, AND HOLD HARMLESS FASTER STRONGER WISER LLC, ITS OWNER GLENN PAYNE JR., OFFICERS, EMPLOYEES, CONTRACTORS, INSTRUCTORS, COACHES, AGENTS, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, "RELEASED PARTIES") FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES, LIABILITIES, COSTS, AND EXPENSES (INCLUDING ATTORNEYS' FEES) ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM OR PARTICIPATION IN ANY WORKOUT, CLASS, OR PROGRAM — WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE.

This release applies to all activities including but not limited to: FSW Live Strong Academy classes, Pick 5 Master 5 programs, the Daily Wellness Checklist, FSW fitness games, workout programs (Bodyweight Training, Strength Training, Cycle Hero, Basketball Strength, Hero Training, Mental Strength Training, Hectic Hundreds), and all other Platform content.

You agree to indemnify, defend, and hold harmless Faster Stronger Wiser LLC and its Released Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use or misuse of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any physical injury, illness, or harm you sustain as a result of participating in any activity described, recommended, or facilitated by the Platform.

To access certain features, you must create an account and game profile. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. You agree not to share your account with others or use another user's account.

The Platform includes: fitness games (Deck of Cards, Spin Math, Treadmill Math, Boxing, Basketball, Hectic Hundreds), workout programs, the Pick 5 Master 5 program, the Daily Wellness Checklist, body metric tracking, class scheduling, a leaderboard, trophies, fitness character progression, and client personal training services.

The 3-Month Custom Personal Training Package is a one-time $250 investment that provides personalized coaching, custom workout and nutrition programming, email support, and portal access. This is a coaching and educational service — not a medical, clinical, or therapeutic service. Results are not guaranteed. No refunds are issued once program delivery has commenced. Completion of the client intake form and active participation are required to receive the full benefit of the program.

Premium memberships are available on a monthly ($2.99/month) or annual ($24.99/year) basis and are billed through Stripe, Inc. Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date. Cancelling a subscription stops future charges but does not provide a refund for the current billing period.

One-time purchases are non-refundable once processed. We reserve the right to modify pricing at any time with notice to subscribers prior to their next billing cycle.

Your game progress, trophies, and stats are retained even if your subscription lapses or is cancelled.

You agree not to: (a) use the Platform for any unlawful purpose; (b) impersonate any person or entity; (c) attempt to gain unauthorized access to any part of the Platform; (d) interfere with or disrupt the integrity or performance of the Platform; (e) upload false, misleading, or harmful content; or (f) harass, abuse, or harm other users. We reserve the right to terminate or suspend accounts that violate these conduct standards.

All content on the Platform — including workout programs, game mechanics, written content, branding, images, audio, video, and the FSW name and logo — is owned by or licensed to Faster Stronger Wiser LLC. You may not copy, reproduce, distribute, modify, or create derivative works from any Platform content without prior written permission.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FASTER STRONGER WISER LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRIOR TO THE CLAIM OR (B) $50 USD.

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Platform shall be resolved exclusively in the state or federal courts located in California. You waive any objection to jurisdiction or venue in such courts.

You agree that any claim must be brought in your individual capacity and not as a plaintiff or class member in any purported class action or representative proceeding.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable.
