These Terms & Conditions (“Terms”) are an agreement between you (“you,” “User”) and Faster Stronger Wiser LLC (“FSW,” “we,” “us,” “our”) governing your access to and use of https://fasterstrongerwiser.com/ (the “Site”) and any related services, content, programs, products, and features (collectively, the “Services”).

By accessing the Site or using the Services, you agree to these Terms. If you do not agree, do not use the Site or Services.

2) Services (Free Programs, Paid Programs, Apparel, and Private Training)

FSW provides:

A) Free Workout & Nutrition Programs (Login Required)

The Site offers workout programs and nutrition programs that are free to use. Access may require creating an account and logging in. The purpose of the login is to allow you to track your workouts and program activity (for example: saving progress, viewing history, and related tracking features).

B) Workout Programs for Sale

We may also offer certain workout programs, digital products, premium materials, or downloadable programs for purchase. Any paid items will be clearly labeled and priced on the product page and/or at checkout.

C) Apparel / Clothing

We offer clothing and related merchandise for purchase at various prices, which will be displayed on the product pages and at checkout.

D) Private Fitness Training

Private training may be available by request. Rates are provided by email only. To request current rates and availability, email owner@fasterstrongerwiser.com.

No guaranteed results. Fitness and nutrition outcomes vary by individual and depend on many factors.

3) Health, Nutrition & Safety Disclaimer (Check With Your Doctor / Use at Your Own Risk)

The workout programs, nutrition programs, and all related content are provided for general informational and educational purposes only and are not medical advice.

Consult Your Doctor

Check with your doctor (or a qualified healthcare professional) before starting any workout or nutrition program, especially if you:

  • have a medical condition, injury, or chronic illness,

  • are pregnant or postpartum,

  • take medications that may affect exercise or nutrition,

  • have a history of disordered eating, or

  • experience pain, dizziness, faintness, or discomfort.

Use at Your Own Risk

You agree to use any workout and nutrition program at your own risk. To the maximum extent permitted by law, you voluntarily assume all risks associated with exercise and nutrition changes, including the risk of injury, illness, adverse outcomes, or property damage.

If you experience pain or symptoms, stop immediately and seek medical advice.

4) Privacy

Your use of the Site is subject to Faster Stronger Wiser LLC’s Privacy Policy. Please review our Privacy Policy, which governs the Site and informs users of our data collection practices.

5) Electronic Communications

Visiting the Site or sending emails to FSW constitutes electronic communications. You consent to receive communications electronically and agree that all agreements, notices, disclosures, and other communications we provide electronically (via email or on the Site) satisfy any legal requirement that such communications be in writing.

6) Your Account (Registration, Tracking Purpose, and Security)

If you use this Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your device, and you agree to accept responsibility for all activities that occur under your account or password.

Account access may be required to support program features such as workout and nutrition tracking and saved progress.

You may not assign or transfer your account to any other person or entity. You acknowledge that FSW is not responsible for third-party access to your account that results from theft, misappropriation, or your failure to safeguard credentials.

FSW and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.

7) Children Under Thirteen

FSW does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use the Site only with permission and involvement of a parent or guardian.

8) Pricing, Payments, and Purchases

  • Free Programs: Workout and nutrition programs available on the Site are free to use, though access may require login.

  • Paid Programs / Digital Products: Some programs, downloads, or digital products may be offered for sale. Prices (and any taxes/fees, if applicable) will be displayed before purchase and/or at checkout.

  • Apparel / Merchandise: Clothing is sold at various prices shown on the product pages and at checkout.

  • Private Training: Private training rates are not listed on the Site; you must email owner@fasterstrongerwiser.com for current rates and availability.

We may use third-party payment processors. Your payment may also be subject to the processor’s terms in addition to these Terms.

9) Cancellation / Refund Policy

Digital Services / Programs

Any cancellations after 30 days of service will not qualify for a refund. Please contact us at owner@fasterstrongerwiser.com.

Apparel / Merchandise

Any shipping, returns, exchanges, and refund terms for clothing/merchandise will be provided at checkout or on the relevant store policy page(s). If those terms conflict with this section, the store policy page will control for merchandise purchases.

10) Links to Third-Party Sites / Third-Party Services

The Site may contain links to other websites (“Linked Sites”). The Linked Sites are not under the control of FSW, and FSW is not responsible for the contents of any Linked Site, including any link contained in a Linked Site, or any changes or updates to a Linked Site. FSW provides these links as a convenience, and inclusion of any link does not imply endorsement by FSW.

Certain services made available via the Site may be delivered by third parties. By using any product, service, or functionality originating from the Site, you acknowledge and consent that FSW may share information and data with third parties with whom FSW has a contractual relationship to provide requested product, service, or functionality.

11) No Unlawful or Prohibited Use / Intellectual Property

You are granted a non-exclusive, non-transferable, revocable license to access and use the Site strictly in accordance with these Terms. As a condition of your use of the Site, you warrant that you will not use the Site for any purpose that is unlawful or prohibited by these Terms.

All content included as part of the Services (text, graphics, logos, images, videos, and software) is the property of FSW or its suppliers and protected by intellectual property laws. You agree not to modify, publish, transmit, reverse engineer, create derivative works from, or exploit any content, in whole or in part, without express written permission, except as allowed by these Terms.

12) Use of Communication Services

The Site may contain message or communication facilities (“Communication Services”). You agree to use Communication Services only to post, send, and receive messages and material that are proper and related to the applicable service.

You agree not to use Communication Services to: defame, abuse, harass, stalk, threaten, or violate legal rights of others; post unlawful, obscene, defamatory, infringing, or inappropriate material; upload viruses or harmful code; advertise for business purposes where not permitted; conduct surveys, contests, pyramid schemes, or chain letters; harvest information about others without consent; or violate any applicable laws.

FSW has no obligation to monitor Communication Services but reserves the right to review, remove, or restrict access to materials in its sole discretion and to terminate your access at any time without notice.

13) Materials Provided to the Site / Submissions

FSW does not claim ownership of materials you provide to the Site (including feedback and suggestions) or post, upload, input, or submit (“Submissions”). However, by providing Submissions, you grant FSW and its affiliates permission to use your Submissions in connection with operating and improving the Services, including the rights to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate, and reformat your Submission, and to publish your name in connection with your Submission.

No compensation will be paid for use of your Submission. FSW is under no obligation to post or use any Submission and may remove any Submission at any time in its sole discretion.

You warrant and represent that you own or control all rights to your Submissions necessary to grant these rights.

14) International Users

The Service is controlled, operated, and administered by FSW from offices within the United States. If you access the Service from outside the U.S., you are responsible for compliance with local laws.

15) Indemnification

You agree to indemnify, defend, and hold harmless FSW, its officers, directors, employees, agents, and third parties from losses, costs, liabilities, and expenses (including reasonable attorneys’ fees) relating to or arising out of your use of the Site or Services, your user postings, your violation of these Terms, your violation of any rights of another, or your violation of any applicable laws.

16) Arbitration

If the parties cannot resolve a dispute arising out of or concerning these Terms, the dispute shall be resolved by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association (or a similar arbitration service selected by the parties), in a location mutually agreed upon by the parties.

The arbitrator’s award shall be final and judgment may be entered in any court with jurisdiction. The prevailing party shall be entitled to recover costs and reasonable attorneys’ fees. This arbitration provision survives termination of these Terms.

17) Class Action Waiver

Any arbitration will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. The parties agree that claims may be brought only in an individual capacity and not as a plaintiff or class member in any class, collective, or representative proceeding.

18) Liability Disclaimer

The information, products, and services available through the Site may include inaccuracies or typographical errors. Changes are periodically added. FSW may make improvements and/or changes to the Site at any time.

To the maximum extent permitted by law, the Site and Services are provided “as is” without warranty or condition of any kind. FSW disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

To the maximum extent permitted by law, in no event shall FSW be liable for any direct, indirect, punitive, incidental, special, consequential damages, or any damages whatsoever arising out of or connected with the use or performance of the Site or Services.

Because some jurisdictions do not allow certain limitations, some of the above limitations may not apply to you. If you are dissatisfied with any portion of the Site or with these Terms, your sole and exclusive remedy is to discontinue using the Site.

19) Termination / Access Restriction

FSW reserves the right, in its sole discretion, to terminate your access to the Site and related services or any portion thereof at any time, without notice.

To the maximum extent permitted by law, this agreement is governed by the laws of the State of California, and you consent to exclusive jurisdiction and venue of courts in California in all disputes arising out of or relating to the use of the Site, except as required for arbitration under these Terms. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms.

20) Changes to Terms

FSW reserves the right, in its sole discretion, to change the Terms under which the Site is offered. The most current version of the Terms will supersede all previous versions. We encourage you to periodically review the Terms to stay informed of updates.
